The legal materials used in SQE2 reflect the real-world working conditions of a Day One Solicitor. The assessment is designed not to test memory or rote recall of legal provisions, but rather to evaluate your ability to apply fundamental legal principles effectively and pragmatically in a client-facing or problem-solving context.
For all assessment stations in SQE2 except legal research, you will be provided with any legal materials that a Day One Solicitor would be expected to consult. These materials may include statutory extracts, case law summaries, or other relevant sources, depending on the nature of the task. However, materials will only be given where it is considered that a newly qualified solicitor, acting competently, would reasonably need to look up specific legal detail. If such detail is not supplied, the expectation is that you should be able to proceed using your foundational legal knowledge.
For instance, in a legal drafting station, if specific statutory wording is required, this may be provided in the assessment materials. Conversely, if the situation requires an application of a basic legal principle, such as the elements of a binding contract or the test for negligence, it is expected that you can recall and apply this without needing additional materials.
