How to Confirm QWE

Confirming Qualifying Work Experience (QWE) is a critical step in the journey of aspiring solicitors. It involves verification by a solicitor or a Compliance Officer for Legal Practice (COLP) to ensure that the work experience meets the required standards. The confirmation process ensures that the candidate's work experience meets the necessary criteria, helping them progress toward becoming a solicitor.

Who Can Confirm QWE?
QWE must be confirmed by a solicitor or COLP. It is important to note that the solicitor or COLP does not need to hold a practising certificate or be employed by the same organisation as the candidate. What matters is that the individual confirming the QWE has a clear understanding of the candidate's work during the relevant period. This requirement ensures that the confirmation is based on direct knowledge of the candidate's performance and development in the workplace.

When to Confirm QWE
Candidates should aim to get their QWE confirmed by each employer before leaving that place of employment. This approach ensures that the work experience is documented promptly and accurately. If candidates confirm QWE as soon as each placement or employment period ends, they avoid potential complications that may arise if confirmation is delayed. It is essential to remember that each employer is only responsible for confirming the QWE undertaken within their organisation. The solicitor or COLP confirming the final period of QWE is not required to confirm the entire QWE history, just the experience gained under their supervision.

What Needs to Be Confirmed
The confirmation process involves several important aspects. First, the solicitor or COLP must have reviewed the candidate's work during the QWE period. If the confirming solicitor or COLP was not directly supervising the candidate, they must have received feedback from the person or persons who did. This feedback provides a comprehensive understanding of the candidate's performance and progress.

In addition to reviewing the candidate's work, the confirming solicitor or COLP must be satisfied that the QWE provided the candidate with the opportunity to develop some of the competencies outlined in the Statement of Solicitor Competence. These competencies are essential for ensuring that the candidate is gaining the skills and knowledge required to succeed as a solicitor. Lastly, the confirming solicitor or COLP must verify that no character and suitability issues arose during the QWE that would prevent the candidate from being admitted as a solicitor.

Confirming QWE is a straightforward but essential part of the qualification process for aspiring solicitors. Candidates are advised to ensure that each period of work experience is confirmed by a solicitor or COLP who has direct knowledge of the their work, so that they can confidently progress toward their goal of becoming a solicitor. It is important for candidates to obtain this confirmation promptly after each placement to ensure that their QWE is accurately documented and meets the necessary criteria.
