Learning Outcomes of LLB Intellectual Property

The learning outcomes of the Intellectual Property module are designed to provide you with a comprehensive understanding of the principles, laws, and practices related to intellectual property rights. If you complete the module successfully, you should be able to:


Demonstrate knowledge of UK statutory framework and case law: You should be able to demonstrate knowledge of the UK statutory framework governing the acquisition, exploitation, and infringement of intellectual property rights, including registered trademarks, patents, copyright, and unregistered designs. You should also be familiar with relevant case law in these areas.


Explain common law principles: You should be able to explain the common law principles that govern passing off (a form of unfair competition) and breach of confidence (a violation of trust and confidentiality).


Describe the impact of EU law: You should be able to describe how EU law influences and limits the use of intellectual property rights, including restrictions on parallel imports and limitations on the freedom to assign and licence such rights.


Understand international conventions and EU secondary legislation: You should be able to understand how international conventions and EU secondary legislation have influenced and shaped the content of the UK legislative framework related to intellectual property rights.


Appreciate the commercial context: You should be able to appreciate the commercial context in which intellectual property rights are created and the manner in which litigation affecting these rights is conducted.


Engage with theoretical debates: You should be able to engage with theoretical debates surrounding intellectual property rights, including discussions about their justification, economic effects, monopolistic tendencies, and ethical considerations.


Apply knowledge to complex situations: You should be able to apply your knowledge of intellectual property to complex factual situations, demonstrating your ability to analyse and apply legal principles to real-world scenarios.


Locate, extract, and analyse information: You should have the ability to locate, extract, and analyse information from multiple sources, including proper acknowledgment and referencing of sources.


Distinguish key issues and formulate clear arguments: You should be proficient in distinguishing key issues, formulating them with clarity, and writing fluently, using correct intellectual property terminology.


Develop critical evaluation skills: You should be able to develop critical evaluation skills, including the ability to recognise potential alternative conclusions for specific situations and provide supporting reasons for them.


Make informed judgments: You should be able to make informed and reasoned judgments based on an understanding of standard arguments in various areas of intellectual property law.
